1. Introduction
1.1. Welcome to IB Doctor Limited ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our services, including our website located at https://ibdoctor.co.uk (the "Website") and any related services (collectively, the "Services").
1.2. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.
1.3. These Terms are governed by English law and comply with the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and other applicable UK consumer protection legislation.

3. Definitions
3.1. "Client", "you", or "your" means any person who uses our Services, including students and parents/guardians.
3.2. "Tutor" means an individual providing tutoring services through our platform.
3.3. "Package" or "Bundle" means a bundle of tutoring hours purchased in advance.
3.4. "Contract" means the legally binding agreement between you and us for the supply of Services.
3.5. "Session" means a scheduled tutoring appointment between a Client and Tutor.
4. Eligibility
4.1. To use our Services, you must be at least 16 years old. If you are under 18, you must have parental or guardian consent to use the Services, and a parent or guardian must agree to these Terms on your behalf.
4.2. Parents or guardians who purchase Services on behalf of a minor are responsible for ensuring compliance with these Terms.
4.3. By using our Services, you represent and warrant that you meet all eligibility requirements.
5. Services
5.1. We provide online tutoring services for International Baccalaureate (IB) students through our custom-built platform.
5.2. The description of the Services is as set out on our Website and marketing materials. All descriptions are for illustrative purposes only and subject to change.
5.3. We reserve the right to modify or discontinue any part of the Services at any time. Where this affects active Packages, we will provide reasonable notice and, where appropriate, a pro-rata refund for unused hours.
6. User Accounts
6.1. To access certain features of our Services, you may be required to create an account.
6.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
6.3. You agree to provide accurate and complete information during the registration process and to keep your account information updated.
7. Booking and Purchasing Packages
7.1. Tutoring sessions can only be scheduled after purchasing a Package.
7.2. Available Packages and their prices are displayed on the Website. Prices are in GBP and include VAT where applicable. Prices are subject to change but will not affect orders already confirmed.
7.3. All payments must be made through our secure payment gateway. We accept various payment methods as indicated on the Website.
7.4. A contract is formed when we send you confirmation of your order. You will receive an email confirming your purchase and providing next steps for tutor matching.
7.5. Package hours are valid for 12 months from the date of purchase unless otherwise stated. Extensions may be granted at our discretion.
8. Your Right to Cancel (Cooling-Off Period)
8.1. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your purchase within 14 days of the date of purchase ("Cooling-Off Period"), without giving any reason.
8.2. To exercise this right, you must inform us of your decision by a clear statement (e.g., by email to hello@ibdoctor.co.uk or by post). You may use the Model Cancellation Form provided in Schedule 1, but it is not obligatory.
8.3. If you cancel within the Cooling-Off Period and have not yet had any tutoring sessions, you will receive a full refund within 14 days.
8.4. If you request that Services begin during the Cooling-Off Period (e.g., by scheduling your first session), you acknowledge that:
- You expressly consent to the Services starting before the end of the Cooling-Off Period.
- If you subsequently cancel, you will be liable to pay for any Sessions already delivered, calculated on a pro-rata basis.
9. First Session Guarantee
9.1. In addition to your statutory rights, we offer our First Session Guarantee. If you are not satisfied with your first tutoring session for any reason, you may contact us within 24 hours of the session ending to request either:
- A free tutor rematch at no additional cost; or
- A full refund of your Package purchase price.
9.2. To claim under the First Session Guarantee, email hello@ibdoctor.co.uk or submit a request via our Support page within 24 hours of your first session.
9.3. Refunds under the First Session Guarantee will be processed within 5 working days of approval.

10. Session Scheduling and Cancellation
10.1. Sessions are scheduled by mutual agreement between you and your assigned Tutor using our scheduling system.
10.2. You may reschedule or cancel a session with at least 24 hours' notice without penalty.
10.3. Cancellations with less than 24 hours' notice may result in the session being deducted from your Package hours at our discretion.
10.4. If a Tutor cancels a session, you will not lose any Package hours and we will work with you to reschedule at a convenient time.
10.5. Repeated no-shows or late cancellations may result in suspension or termination of Services.
11. Client Responsibilities
11.1. You agree to:
- Ensure that all information you provide is accurate and up to date.
- Comply with all applicable laws and regulations.
- Respect the Tutor's time by attending scheduled sessions promptly.
- Ensure you have appropriate equipment and internet connection for online sessions.
- Communicate any issues or concerns to us immediately.
- Maintain academic integrity at all times (see Section 14).
12. Tutor Responsibilities
12.1. Tutors are responsible for:
- Providing tutoring services with reasonable care and skill in accordance with the Consumer Rights Act 2015.
- Being punctual and prepared for each tutoring session.
- Complying with our Code of Conduct, safeguarding policies, and all applicable laws.
- Maintaining appropriate professional boundaries at all times.
13. Safeguarding
13.1. The safety and wellbeing of our students is our priority. We are committed to safeguarding and promoting the welfare of children and young people.
13.2. All Tutors undergo identity verification and are required to adhere to our safeguarding policies.
13.3. Sessions are conducted online via our approved video platform. We recommend that students under 18 have a parent or guardian present during sessions, or that sessions take place in a common area of the home.

14. Academic Integrity
Important Notice
Our tutoring services are designed to support and enhance your learning. We do not provide services that would constitute academic misconduct.
14.1. You acknowledge that all work submitted to your school or examination body must be your own. Tutors will guide, explain, and review your work, but will not complete assignments on your behalf.
14.2. For Internal Assessments (IAs), Extended Essays (EEs), and other coursework, Tutors may:
- Help you understand marking criteria and requirements.
- Provide feedback on drafts (within IB academic integrity guidelines).
- Explain concepts and methodologies.
- Suggest improvements and areas for development.
14.3. Tutors will NOT:
- Write or rewrite any part of your coursework.
- Complete assignments, past papers, or homework on your behalf.
- Provide answers to examination questions.
- Engage in any form of academic dishonesty.
14.4. You are responsible for ensuring your use of our Services complies with your school's academic integrity policies and the IB's academic honesty policy.
15. No Guarantee of Results
15.1. While our tutoring services are designed to support your academic development, we do not guarantee specific grades, examination results, or university admissions outcomes.
15.2. Academic success depends on many factors including your own effort, attendance, engagement, and external circumstances beyond our control.
15.3. Any testimonials, case studies, or statistics shared on our Website (such as average grade improvements) represent past results and are not a guarantee of future performance.
16. Intellectual Property Rights
16.1. All content, materials, and software on the Website are the intellectual property of IB Doctor Limited or its licensors.
16.2. You may not reproduce, distribute, or create derivative works from any content on the Website without our express written permission.
16.3. Any materials provided by Tutors during sessions are for your personal educational use only and may not be shared, sold, or distributed.
17. Limitation of Liability
17.1. Under the Consumer Rights Act 2015, Services must be performed with reasonable care and skill. If we fail to meet this standard, we will, at your choice, re-perform the Services or provide an appropriate refund.
17.2. We are responsible for losses you suffer caused by us breaking this Contract unless the loss is:
- Unexpected: It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it.
- Caused by a delaying event outside our control (see Section 18).
- Avoidable: Something you could have avoided by taking reasonable action.
17.3. Our total liability to you for any loss or damage arising out of or in connection with these Terms shall be limited to the total amount paid by you for the Services.
17.4. Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Any other liability which cannot be excluded or limited under English law.
18. Events Outside Our Control (Force Majeure)
18.1. We will not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, or extreme weather.
- Pandemic, epidemic, or public health emergency.
- War, terrorism, or civil unrest.
- Government actions or restrictions.
- Power outages, internet failures, or other telecommunications failures.
- Industrial action or strikes (other than of our own employees).
18.2. If such an event occurs, we will contact you as soon as possible to notify you and will use reasonable efforts to minimise the effect of the delay.
18.3. If the delay continues for more than 30 days, you may cancel the Contract and receive a pro-rata refund for unused Package hours.
19. Privacy and Data Protection
19.1. We are committed to protecting your privacy and personal information. Please review our Privacy Policy for details on how we collect, use, and protect your data in accordance with UK GDPR and the Data Protection Act 2018.
19.2. By using our Services, you consent to the collection and use of your information as outlined in the Privacy Policy.
20. Confidentiality
20.1. All parties agree to keep confidential any proprietary or confidential information disclosed during the provision of Services.
20.2. This clause does not apply to information that is public knowledge or required to be disclosed by law.
21. Termination
21.1. We may suspend or terminate your access to the Services if you breach any of these Terms.
21.2. You may terminate your account at any time by contacting us at hello@ibdoctor.co.uk. Unused Package hours may be refundable at our discretion, depending on circumstances.
21.3. Upon termination, any rights granted to you under these Terms will cease immediately.
22. Changes to Terms
22.1. We may revise these Terms from time to time. The most current version will always be posted on our Website.
22.2. If a revision is material, we will notify you via email or through the Website. By continuing to access or use the Services after revisions become effective, you agree to be bound by the new Terms.

23.2. We will acknowledge your complaint within five (5) working days and aim to resolve it within 14 working days. Complex issues may take longer, in which case we will keep you informed of progress.
23.3. If we cannot resolve a dispute amicably, you may be able to use the EU Online Dispute Resolution platform (available at https://ec.europa.eu/consumers/odr) or alternative dispute resolution services.
23.4. If we cannot resolve a dispute through the above means, it shall be governed by the laws of England and Wales, and both parties submit to the exclusive jurisdiction of the English courts.
24. Governing Law
24.1. These Terms are governed by and construed in accordance with the laws of England and Wales.
24.2. If you are a consumer, you will benefit from any mandatory provisions of the law of your country of residence.
25. Miscellaneous
25.1. Entire Agreement: These Terms, together with our Privacy Policy, Cookie Policy, and First Session Guarantee, constitute the entire agreement between you and IB Doctor Limited regarding the Services.
25.2. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
25.3. Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
25.4. Third-Party Rights: A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms.
25.5. Assignment: We may transfer our rights and obligations under these Terms to another organisation. You may only transfer your rights or obligations under these Terms with our written consent.

Important Notes
- • Your Statutory Rights: Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, or other applicable UK consumer protection legislation.
- • Consumer Rights Act 2015: Under this Act, services must be performed with reasonable care and skill. If we fail to meet this standard, you may be entitled to a repeat performance or a price reduction.
- • Professional Standards: We adhere to all relevant UK regulations and professional standards to ensure the highest quality of service.
